GESTATIONAL SURROGACY
In Brazil, it must be voluntary and cannot be carried out on a commercial basis. It is an assisted reproduction method that enables a family to have a child with their own genetic heritage, even if the pregnancy is not carried by one of the partners.
According to Resolution No. 2,320/2022 of the Federal Council of Medicine (CFM), the temporary uterine donor must have at least one living child and must belong to the family of one of the partners, being a blood relative up to the fourth degree (first degree: parents and children; second degree: grandparents and siblings; third degree: uncles/aunts and nieces/nephews; fourth degree: cousins). If this degree of kinship does not exist, authorization must be requested from the Regional Council of Medicine of Rio de Janeiro (CREMERJ).
In addition to undergoing a series of tests proving that they are medically fit to act as a gestational carrier, if the person is married or in a stable union, they must provide written authorization from their spouse or partner.
The success rates of this procedure are similar to those achieved in In Vitro Fertilization (IVF/ICSI) and Intrauterine Insemination (IUI) cycles, reaching up to 68%. Gestational Surrogacy is indicated in the following cases:
● When there is an absence of the uterus, whether congenital or acquired due to hysterectomy caused by a disease;
● When a significant uterine abnormality is identified that prevents pregnancy and cannot be corrected;
● When there is a diagnosis of a disease associated with a high risk of death during pregnancy;
● When there have been several unsuccessful embryo transfer attempts and uterine factors are suspected to be the cause;
● LGBTQIAP+ families that do not include a person with a uterus and therefore require a gestational carrier.
The steps for Gestational Surrogacy are the same as those for IVF/ICSI, since the eggs are retrieved from the ovaries for laboratory fertilization. After careful embryo monitoring, the embryos are transferred to the previously prepared uterus. From that point on, the pregnancy progresses naturally.
